Last Friday 5/30/08 we drove with a process server from our Attorney's office to deliver
papers requiring VJM secretary to appear for a deposition and to bring paperwork with her.
Don is 74 and was assaulted by the secretary's hothead husband. He must be in early 60's.
Don asked if Ms. Adams was home, Jon said "no." Don asked "are you Jerry?" Don had papers
to serve on VJM and since he was becoming too difficult to find and serve, we were told the papers could be served upon his secretary since she has Power Of Attorney for VJM.
The minute Don asked "are you Jerry?" Jon said "no" and hauled off and slugged Don in the jaw with a right hook. Then Jon Adams continued pummeling, hitting Don in the head, face body etc. They tumbled off the porch and ended up in a wrestling match on the ground. David tried to get out of the car to help but his seatbelt was stuck. I tried also but my seatbelt AND my door was stuck (like a child proof lock that you can't figure out). Finally David was able to free himself and ran around the car and got between them. Finally they got up and David kept his arms out to keep them apart. Jon kept coming at Don, with David saying "hey, hey hey...."
I could never get unstuck so I leaned forward and shouted through the open driver's door.
I shouted hysterically "Jon Adams! Jon Adams! Jon! Jon Adams!" He finally stopped still
and looked at me while holding his arm. I screamed "what do you think you're doing?!"
He looked straight at me. We didn't know each other but I knew that was him because he had told Don, "no, I'm Jon." Just before he hit Don. Don is an actual attorney but has worked in a low key position for years for my Attorney. He serves papers and does other miscellaneous but helpful filling in of gaps. Jon seemed to focus on me - curious. He then went in the house.
During the battle he picked up the papers, looked at them and threw them on the ground.
Don said "you're served." We left with the papers and VJM's envelope all strung about the driveway. We went straight to the Sherriff's office and filed three reports. David and I as witnesses. Don signed a Complaint against Jon. Three Deputies showed up to talk to us.
They said they had already been to the hospital by the time we got to the Sherriff's. Jon had immediately gone to the hospital and claimed a broken arm (perhaps he did have as his arm got caught under Don according to Don as they fell to the ground - so it was possible). Jon gave the wrong descrip of our car (Don's) and they stopped an innocent young female at the Truck Stop. She didn't know what they were talking about. Also Jon said as an excuse - some people came to my house and they were at the wrong house. "Oh," said David, later to us - "so if someone makes a mistake and comes to the wrong house you are supposed to beat them up for it?"
Yeah right. We were at the right house of course. Their mailbox was extra large and black and had their last name on it hanging across the road. David and I had been there once before to pick up keys from Ms. Adams. They live in Good Grief Idaho. About 30 miles from Town.
So now we are expecting to have to be witnesses at any Hearing where Don would be speaking about the incident. The deputies said - "well he thinks that by being the first one to call in that we will believe him before we believe you.... but that's not how it works. He seems to know the "drill." One deputy said that "he seems to know the drill". Anyway they said they believed us immediately. We have now heard a rumor floating about that small community, that Jon was found to have cancer when he went to have his arm checked for being broken. The word is that he has some special type of fracture a "spiral" fracture? And that was why his arm broke so easily is that he has cancer. I don't know if this is true or a way for him to get sympathy and hope that Don doesn't throw the book at him. I don't know what the outcome will be. If it turns out to be true then if I were Don I would be inclined to ask the Judge for some kind of sanctions or fine or something from Jon but I would say "he is probably being punished enough - having cancer." He is known as a real hothead in this community. Whew! What a story huh?!
Drama at every turn! More and better news later.
